摘要
妥善处理争端是政府间国际组织保持内部团结、谋求稳定发展的先决条件。本文对于在此方面做得比较成功的东盟组织在处理内部争端当中所遵循的原则,尤其是所采用的渠道和方式进行了探讨。指出,就渠道而言,其成员国处理彼此争端不是在东盟的组织框架内,而是在国家关系的层次上通过双边努力进行的;就方式而言,可以归纳为:“广泛协商,寻求一致”、“搁置争议”、“自我克制,互谅互让”以及“利用第三方从中调解”等四种。这些原则、渠道和方式对于东盟缓和内部矛盾、化解争端。
Managing intra-disputes in an effective way is one of the preconditions of international govenment organizations in their pursuit of inner solidarity and stable development.This paper probes into the principle,channels and ways used by ASEAN in managing disputes between its member-states,which have been quite successful in this respect.So far as the channel is concerned,ASEAN's dispute-management is not conducted within its institutional framework.Instead,it is done by bilateral means at the international level.As for the ways,they can be concluded as “Consultation and consensus”,“Shelving disputes for later settlement”,“Self-restraint”and“mutual tolerance”as well as“Third-party mediation”.These ways and channels play an important role in alleviating contradictions,resolving conflicts and preserving unity among ASEAN members.
