摘要
我国《城市房地产管理法》规定了房地产权属登记 ,而对其登记效力未予明确 ,部门规章规定又与之不一致 ,造成司法审判结果的不一致。本文从国外有关不动产登记效力的法律制度入手 ,分析了我国不动产登记效力的法理依据 ,指出应确立我国不动产登记的要件原则 ,废止司法解释关于不动产共有善意取得制度。
The L aw on the Adm inistration of City Real Estate of the PRC stipulates the registration of the title to real estate,but there is no clear provision on its effects,and in this respect,this L aw is not in conformity with previous department regulations.Consequently the judgem ents in judicial practice vary.This article starts from the rules of foreign countries on the effects of the real estate registration,examines its jurisprudence grounds,and points out the necessity of establishing the principle for the formal real estate registration,abolishing the system set up by the judicial explanation on the innocent acquisition of the joint tenancy.
