本文在对传统的权利承认→保护→实现理论进行反思后认为：权利具有冲突性，因此其能否真正为其主体所实现并不在于法律的承认和保护，而在于行政、司法机关的配置。文章指出，对冲突权利进行配置时应遵循基本权利优先于非基本权利原则、利益衡量原则、衡平原则和公平限制原则。最后。

The paper assumes that right has conflicts after studying the tranditional theory of right recognition→right protection→right realization, therefore, the realization of right doesnt lie in the recognition and protection of law, but lies in the disposition of administrative and judicial organs. In addtion, the paper points out that disposition of conflict of right follows the principles of basic right prior to the non basic right, benefits measureing, equity and justice restrictive principles. Finally,the paper goes further into the subjects concerning the right of disposition to the right of conflicts.
