Legal Evaluation Indexes

法是调整社会关系的产物,其归宿是能够为人们的行为提供一套规则,因此,法律评价的最终指标,是现行的法律是否能够满足社会的需求,也就是能否为社会关系的调整提供一套可行的规则。能否满足社会发展的需求,既存在于整个法律体系(也就是说,从总体上看,该法律体系是否能为社会关系的调整提供一套完整、正当、可行的规则),也存在于某一部规范性文件和某一个条文。

Law is the product of social adjustment,whose aim is to provide a set of rules for social conduct.Therefore,the final indexes of legal evaluation are to show to what degree the laws can meet social needs,i.e.whether a set of feasible rules have been formulated.This can be measured in terms of the law as a system(i.e.whether a set of complete,fair and feasible rules are specified) and as a formal document of items.
