The Law System in Modern Asia

亚洲现代法治是一种“追赶型”法治。本文在论述西方法治的普适性与局限性、现代法治类型划分之后，通过对转型社会的亚洲现代法治在产生溯源、体制障碍、社会背景、法律文化的会通与整合等方面的特征分析，联系亚洲金融危机，提出了亚洲现代化过程中，如何寻求真正的法治秩序等问题。旨在对亚洲现代化的研究建立在较深入广阔的宏观比较与分析基础上。

Abstract The law system in modern Asia is a “running after” system by nature.In dealing with the application and limitation of the law system in western society,and the catogorization of the moden law system,the article discusses the origin,the system deficieneies,the social background,the law culture and their integration and communication in the modern Asian societies.Against the background of recent financial crisis in Asia,the author raises the issue of maintaining the genuine law order in the modernization process in Asia,thus placing the Asian study on the basis of broad comparison and detailed analysis.
