摘要
评析法律移植理论的不同观点,澄清对移植的模糊认识;通过对实践中法律移植的分析,认为只要移植的法律能转化为接受国发展的需要,法律移植就会成功。论证法律移植的可行性和必要性,提出法律移植是我国法律改革的手段之一。
It discusses different viewpoints on theory of laws transplanting, clarifies the indistinct understandingwith regard to transplanting: through analyzing laws transplanting in practice, it thinks as long as transplanting laws can transform to the developmental needs of accepting state, laws transplanting will ucceed. It also proves the feasibilities and necessities of laws transplanting, proposes laws transplanting be one of the means of our courtry's laws reform.
