企业资产重组与国家竞争政策的选择

Assets Combination of Enterprises and the Choice of National Competition Policies

企业资产重组，实施大企业、大集团战略已成为我国今后一段时期经济体制改革的主要任务之一，企业之间的市场竞争将日趋激烈，制定和调整满足市场竞争需要的法制、政策体系和执法框架，完善我国竞争政策已成为国家的一项紧迫工作。本文针对目前我国维护竞争的法规框架中存在的不足及问题，从加强竞争政策法规的统一协调性、规范市场竞争行为、正确对待垄断竞争行为、制定符合我国实际国情的反垄断法规等方面论述了我国应选择的竞争政策。同时指出对垄断问题要更新观念。

It is one of the main tasks for the reformation of economic system to carry out the strategy of big group and big enterprises by the combination of the enterprises assets in the near future. The heated competition in the market among companies demands an immediate action to establish and adjust the frame of execution, the system of legislations and certain policies to meet the need of competition in the market and to complete the competition policies of this country. This article aims at the weaknesses and problems in the legislative frame of the competition protection at present and discussed the competition policies to be chosen from the following respects:strengthening the coordination of the laws and regulations of competition policies; standardizing the behaviors of competition in the market; treating the behaviors of monopolized competition properly; and working out the antimonopoly laws and regulations according to the radical situations of this country. This article points our at the same time that ideas should be changed on the problems of monopoly and an understanding be reached of the behaviors of monopolized competition.
