试论制作、传播计算机病毒罪

On the crime of making and spreading computer virus

本文提出计算机信息系统的安全不能仅靠计算机技术本身,探讨了制作、传播计算机病毒的社会危害性,论述了将此行为规定为犯罪行为的必要性.分析了此罪的犯罪构成。该文还对新《刑法》第286条提出了修改建议。

The paper holds that the safety of computer information system can not only depend on the technology of the computer itself. The author analyses the perniciousness to the society of making and spreading computer virus, the necessity of stipulating making and spreading computer virus a kind of criminal offense and the constitution of the crime. The auther also gives some ideas on how to amend Article No. 286 of the newly adopted Criminal Law (1997).
