文章就矿产资源法中关于矿权性质、土地权与矿权的矛盾在立法上表现出来的缺陷、限制矿业权二级市场流转的问题以及采矿优先权进行了阐述 ,提出了完善矿产资源法的几点建议。如理顺矿产资源与土地的关系、取消对矿业权二级市场流转的限制、补充完善采矿优先权等。

The paper illustrates some problems with regard to the nature of mining rights; the imperfecting legislation concerning the contradiction between land rights and mining rights; place restrictions on the turnover of secondary market of mining rights and priority of exploration rights. Accordingly, the paper gives some proposals, such as straightening out the relations between mineral resources and land; lifting the restrictions on the turnover of secondary market of mining rights and complementing and perfecting priority of exploration rights.
