夫妻财产制是实现社会性别平等的重要制度保障。离婚夫妻财产分割是夫妻财产制的重要组成部分,也是实现社会性别平等的关键之一。用社会性别分析方法审视现行夫妻财产制是实现社会性别平等的必经之路。中国的夫妻财产制和离婚夫妻财产分割原则及方法仍然存在着很多社会性别盲点,必须认识这些盲点,完善现行立法,方能发挥夫妻财产制促进夫妻之间社会性别平等的制度价值。

Recognition of marital co-ownership is an important step in realizing gender equality.Division of property in divorce is a crucial element in the concept of marital co-ownership,key to gender equality.To undertake analysis of marital co-ownership from a gender perspective is a necessary step towards building gender equality.Principles guiding marital co-ownership and the division of property in divorce in China still have not taken gender fully into consideration.Recognition of these gender blind spots in the principles will help improve legislation using marital co-ownership as an impetus to promote gender equality.
