摘要
鉴于FIDIC合同条件在我国越来越多的使用,依据FIDIC公平、公正、效率的风险分担准则,提出了一些合同风险分担的看法,对"有经验的承包商能够合理预测和防范"这一模糊概念,做出一个特别的界定,对承包商和业主的责任承担作进一步详细的解释,可以为自然灾害发生后的责任合理分担提供参考,减少双方的争议和纠纷。
FIDIC contract conditions are more and more used in China in recent years,according to fairness,justness and efficiency of FIDIC,a view of risk allocation are put forward.Toward an experienced contractor can forecast and prevent,which is an ill-defined concept,this paper makes a special definition for this concept and further explains the risk responsibility of contractor and owner in order to provide reference for responsibility allocation after natural disaster and reduce contract parties'dispute and issue.
