论著作权中的发行权用尽规则

著作权中的发行权是一项重要的权利 ,其用尽规则在平衡各方利益、合理地限制知识产权、促进公共利益等方面起着十分积极的作用。面对即将加入WTO的形势 ,在我国有关著作权的立法中正式确立发行权用尽规则已成为现实的迫切需要 ,现在该是对我国现行著作权法进行修改的时候了。各国对发行权用尽规则有不尽相同的立法规定 ,它们对我国在这方面的立法具有较大的借鉴意义。“版权穷竭原则”的提法值得商榷 。

The right of issue is an indispensible item of copyright,and its exhaustion rule plays an active role in the balance of interest 、reasonable restriction of the right of issue and promotion of public interest. On China's entry of World Trade Organization,it has become a necessity to legislate the exhanstion rule of the right of issue, and now, it is absolutely necessry to revise the law of copyright.Not all the legislation rules on the exhaustion rule of the right of issue in different countries are identical, and we can make use of them.The exhaustion rule of copyright should be dissussed and it is not the equal to the exhaustion rule of the right of issue.
