摘要
目前学界对循环经济法的部门归属尚未统一认识,本文结合对各种循环经济法的定性观点的分析和评价,重点通过比较环境法和循环经济法的基本概念,阐述分析环境法的历史发展轨迹和各阶段的特点,详细论证包括循环经济调整对象、法律理念、法律价值和原则、法律内容和特征在内的法理内容等,进而表明循环经济法属于环境法的观点。
No consensus has been achieved regarding the adscription of the circular economy law.By means of qualitative study method,this research has compared the basic concepts involved in the environmental law and the circular economy law.Through elaborating on the developmental history and characteristics of environmental law in different stages in light of the circular economy law in its objects of adjustment,legal philosophy,principles,content and characteristics,this paper suggests that the circular economy law and the environmental law belong to the same category.
