量刑的失衡与矫正对策

作者针对我国司法实践中存在的量刑失衡现象,探寻了造成量刑失衡的原因:(1)刑事立法不完备;(2)法官的素质问题;(3)审判体制的因素;(4)某些行政机关的干预等等。针对这些原因,作者提出了一系列对策:(1)修改刑事立法;(2)实行法官责任制;(3)完善党的领导;(4)改革审判体制等等。

Undue punishment is not unusual in China, There are several reasons to account for that: the incompletion of crimi-nal legislation, the unreasonable system of judgement, the in-terference of administrative departments, etc. To solve these problems, the author gives the following suggestions: revise and finalise the criminal laws, adopt the judge responsibility system, straighten out the relationsthip between government and judicature, and improve the control of Party over justice.
