“所有权”和“产权”是两个不同的概念,“所有权”是资本的价值形态,属於股份持有人,“产权”是资本的使用价值形态(物化形态)、属於企业法人.“所有权”和“产权”的分离体现了资本的原始所有权和生产经营社会化之间的矛盾的调和,是货币资本为寻求利润最大化而同最佳人力资本结合的产物.

“ Ownership”and “ property rights” are two different concepts. “ Ownership” is related to the value of a property, whereas “ Property rights” indicates the right of using such a property. The separation of “ ownership”and “ property rights” is the result of letting the capitals, for the purpose of maximization, be combined with the best human resources.
