社会林业权属的作用──内涵──及其政策重点

The role, meaning of the social forestry and the emphasis of the policy

权属问题是我国社会林业的关键环节。社会林业权属应区分为林地和林木两种权属，包括了授权、权利、责任等内容。但是，由于长时期以来对林业权属的片面认识，导致我国在农村的林业权属方面存在着重视名义上的所有权而轻视其经济上实现，重视收益分配权而轻视经营决策权，注重最终产品的收益而忽视中间阶段的收益，强调责任与义务而忽视权利等倾向。为此，文章强调指出．在我国现阶段，应当把保障林地使用权作为社会林业政策的重点。既要保证使用权的稳定和合理权能的行使不受侵害，又要合理地解决林地使用权的转让与补偿问题。

Abstract The author thinks that, the issue on ownership is the focus of China,s forestry. In the past many years, the unilateral thinking about forestry rights, led to the error trends as follows: paying attention to the name ownership, the income distributional rights, the final product income, the responsibility and duties, and meanwhile looking down on the economic realization of the ownership, the operational decision-making power, the iincome of the medium products, and so on. For this sake, the paper points out that, at present stage. the emphasis should be put on securing the using rights of forestry. On the one hand, guarantees the using rights stable and prevent the rational rights and functions from being violated, and on the other hand, resolutes the issue on transferring the using rights of forestry.
