ON OPERATION OF LAW

法律实施的理论内涵，应当体现两个统一，即程序上贯彻实行与实体内容的实现相统一；实在法的实现与法的应然精神和价值的实现相统一。法律实施的评价标准．与之相适应，应该设置在法律实施的行为、活动过程；实然实体实现效果；应然实体实现效果三个层面。法律实施在一定意义上是体现投入产出关系的社会活动过程，适度投入及成本资源优化配置，是保证法律实施和实施效益的必要条件。

The theoretical connotation of operation of law should embody the two uni-ties, the unity of the legal procedure and the realization of the contents of the entity,the uni-ty of the realization of the existing laws in effect and the realization of the rational spirit andvalue of law. Consequently,the criteria for the evaluation of operation of law should be set upwith regard to the operational procedure of law,the actual effect of the contents of the lawsin force and the actual effect of the rational spirit and value of law. In a sense,the operationof law is the process of social activity reflecting the inputoutput relation. Anappropriate inputand a good composition of resources are the prerequisites for the guarantee of the operationof law and the benefit of the operation.
