摘要
与中国单一的法院系统相比,美国的法院组织显得十分复杂。在美国,国会和州立法机构都可以分别组织自己的法院系统以适应各自的需要。其结果不仅联邦法院的结构和制度不同于州法院,州法院之间也有巨大的差异。在实体法和程序法上,每个州都能自由地决定他们自己的犯罪标准以及对犯罪的量刑和惩罚的方式。因此两个州对同一个犯罪行为可能有完全不同的惩罚。同样,在民事案件中,不同的州有不同的民事法律。
The court system in United States is more complicated compare with single court system of China. In USA, Congress and lawmaking institution can set up their own court system according to their needs. As a result, there are big differences between federation court and state court, also between state courts. In entity and formality areas, each state can decide its standards for commit a crime, measurements of a crime and punishments. Therefore, different states might have different punishment for a same crime. Different states also have different civil law for their civil law cases.
