论企业产权转让制

ON TRANSFER OF ENTERPRISE PROPERTY RIGHT

文章认为,企业产权转让制的出现,为优化资源配置提供、了新的途径。它的出现,既是从理论上对企业财产关系的认识不断深化的结果,也是在实践中处理国家投资增量有限和社会资产存量部分闲置的矛盾、优化宏观资源配置的必然要求。但是,企业产权转让制的全面实施,需创造的条件:一是进一步明确财产关系;二是逐步实现政府对企业的"财产经营型"管理;三是逐步推行企业产权交易制度;四是解决好破产企业或转让企业的债务清偿问题;五是用法律手段保障企业买卖顺利进行,等等。只有完善了这些条件,企业产权转让的发展前景才会展现在人们面前,而其积极的社会效益也将会全面地发挥出来。

Recently in China emerges a system of transferring the enterprise property right.Thisprovides a new way for bettering the resource distribution.On the one hand,it's an inevitableoutcome in reunderstanding theoretically the property relations of the enterprises;on the other,it's an inevitable requirement to deal with the contradiction between the limited increase ofstate investment and the existence of idle assets,and to improve the mechanism for an overallresource distribution.In order to put this new system into practice comprehensively,and giveit active and full play to social efficiency,it's urgent and necessary to make the followingpreparations:1)To further straighten out the complicated property relations of enterprises;2)To letthe enterprises be gradually managed by the government in‘property-run’type;3)Toestablish a system where property right can be traded;4)To settle the question of debtpayment of bankcrupt and property-transferred enterprises;5)To formulate related statutes toensure such dealing to go smoothly;and so on.
