摘要
一、土地所有权与土地使用权的分离是土地使用权出租的依据土地是人们进行生产劳动和生活的场所,它是一项重要而有限的资源。城市化、城市现代化的过程,综合反映在城市经济的日渐发展,从而使有限的城市土地需求日益扩大,促使城市土地的开发利用不断向广度和深度发展。
The main issues brought forth in this article include: a) the disintegration of land ownership from theright to use the land as the basic principle to be observed'in leasing the right to use the state-owned land; b )problems concerning the land price, the terms of leasehold, its investment environment and the investment security in leasing the state-owned urban land; c ) the impact of leasing on the economy and the potential problems thereof.
