中华人民共和国和美利坚合众国贸易关系协定,确立了发展中美贸易关系所必须遵循的基本法律原则。这个协定是根据1978年12月15日中华人民共和国政府和美利坚合众国政府关于建立外交关系的联合公报的精神于1979年7月7日签订的,并于1980年2月1日正式生效。中美建交和中美贸易协定的签订,为中美贸易的发展创造了有利条件。1979年建交的第一年,中美进出口贸易总额比1978年增加了一倍多,达24亿美元,1980年又增加近一倍,达46亿美元,1981年又比1980年增长26.8％。

The establishment of diplomatic relations and the conclusion of the trade agreement between China and the United States have provided favourable conditions for their bilateral trade expansion. The principles of equality and mutual benefit and non-discriminative treatment have become the basic legal norms which are binding on both sides in their relations of trade. China has sustained large deficits in her trade with the United States over the past 3 years. Complaints should be laid at the door of the United States for some of its unequal legislations, which, if not amended, will undoubtedly impede the sustained growth and long term development of the trade between the two countries.
