摘要
环境损害赔偿基金制度就是环境风险预防机制中很重要的一环。它在一定程度上可以减少环境损害转嫁给社会的环境治理成本,同时增加行为人的行为成本。在弥补受害人的损失,补救对侵害行为造成的环境污染和生态功能的下降方面起到非常重要的作用。本文以《船舶油污损害赔偿基金征收使用管理办法》为例,阐述环境损害赔偿基金制度的构成。
Environmental Damage Compensation Fund System is a significant part in this Precautionary system , and to some degrees it can reduce the social environmental management cost caused by environmental damage , and relatively heighten doers'action cost .This sys-tem ensures sufferers sufficient or proper compensation , and also plays an important role in remedying environmental pollution and Ecological function declination .This article takes "Rules of SOPF Levy and Apply"as an example to describe the constitution of Environmental Dam-age Compensation Fund System .
