知识产权侵权诉讼中的证据收集问题研究

知识产权的侵权方式日益多样化,知识产权客体具有种类繁杂、专业技术性强、不稳定、易毁灭等特性,收集难度较大。应当结合知识产权侵权证据收集的特殊性,健全诉前证据保全的法律体系,规范证据保全公证的程序,完善司法鉴定制度,完善当事人收集证据权利保障制度,加强法官的释明义务以保障知识产权诉讼的顺利进行。

The infringement of intellectual property rights increasingly tends to be diversified.Since the obj ects of intellectual property are complicated in kinds,strong professional in technology,unstable,and easy to be destroyed,they are difficult to be collected.The paper thinks that the successful fulfillment of in-tellectual property infringement action depends upon sound legal system of pretrial evidence preservation, standard notarial procedure of perpetuation of evidence,perfect j udicial authentication,complete security system of the party’s right to collect evidence,and strengthening j udgers’obligation of interpretation.
