On the Perfection of the Collective Land Requisition Compensation System

现行土地征收补偿制度带有明显的计划经济特征,其确立的是一种纯粹的补偿关系,而缺乏对被征地农民生产和生活需求的考虑,从而导致补偿标准过低。因此引发了一系列社会矛盾。随着我国城镇化进程的快速发展,这些矛盾有愈演愈烈之势。因此,从宏观和微观两个层面,通过确立市场导向、更新立法理念、变革制度以及明晰产权以及确立农民利益本位观的价值取向,构建一套完整、行之有效法律规范,保障农民的土地权益,尤为必要。

The current land requisition compensation system has the characteristics of the planned economy,which is a pure compensation relationship,lack of consideration of the landless farmers’ production and living needs.The compensation standard is too low,which may cause a series of social conflicts that may be even intensified with the rapid development of urbanization.Therefore,it is particularly necessary to establish a market-orientedfrom both the macro and micro levels,with updated concepts,changes of the system,clear property rights and the orientation of value of the farmer-based interests,so as to build a complete,well-established legal norms,and protect farmers’ interests in land.
