法国国际私法中的国籍问题

On the Issue of Nationality in French International Private Law

制定国籍法对境内居民实行管理的权力直接来源于国家主权。在法国国际私法学中认为国籍法属于公法性质的法律规范,但法国国际私法主体必然由法国国籍法所规限,因此将其列为国际私法的研究范畴,而判定一个人是否拥有法国国籍只能依据法国法。法国国籍法的主要内容包括法国国籍的一般概念、法国国籍法的理论依据、法国国籍法的历史演进和法国国籍的具体规定。

The right of formulating the nationality law to govern domestic residents comes directly from the state’s sovereignty.In the French International Private Law,the nationality law is taken as the legal norm of public laws.However,the subject of French International Private Law is definitely regulated by French nationality law.Thus,it is fallen into the research field of International Private Law,whereas judging a person whether he or she has French nationality can only be based on French laws.The French nationality law mainly includes general concepts of French nationality,theoretical basis and historic evolution of French international law,and specific regulations of French nationality.
