论合作契约理念在经济法中的确立与展开

On Establishment and Development of Cooperative Contracts in Economic Laws

随着社会主义市场经济的不断完善,担负着进行宏观调控、维护市场秩序、保证社会可持续发展重任的经济法也必须有所变革。传统的"命令——服从"式的调控模式应向"共同决策——合作执行——责任自负"式的调控模式进行转变,以防公权力被滥用。在这个转变过程中,将合作契约理念融入到现代经济法的实质内涵之中,不失为一种可行的路径选择。通过对合作契约理念的内涵、理论基础进行阐释,提出合作契约理论视野下经济法在宏观层面的制度设计。

With the continuous improvement of socialist market economy,there must be reforms on economic laws which undertake the tasks of implementing macro-control,maintaining the market order and ensuring the sustainable development of the society.Traditional adjusting and controlling pattern of "order-obey" should be changed into the one of "co-decision-cooperative execution-on one’s own responsibility",so as to prevent the public power from being abused.In this transformation process,it is a workable choice to integrate the ideas of cooperative contracts with the actual connotations of modern economic laws.By interpreting the connotation and theoretical basis of the ideas of cooperative contracts,this paper proposes the institutional design on the basis of cooperative contract theories at the macro-level.
