Legal Status of Government in Entrustment of the Farmland Use Right——Taking Shaoxing Mode in Zhejiang Province and Yiyang Mode in Hunan Province as Example

在农村土地使用权信托的不断发展过程中,政府发挥了重要的作用。通过农村土地使用权信托主体构成,探讨了政府角色;介绍了浙江绍兴和湖南益阳农村土地使用权信托模式的构造,比较分析政府在这两种土地使用权信托中的地位以及所发挥的功能;最后通过政府在农村土地使用权信托中法律地位分析明确了政府在此信托中的职能。

Government plays an important role in the developing process of entrustment of rural land use right. The role of government was discussed through analyzing the entrusting subject composition of rural land use right, in which the composition of rural land use right of Shaoxing Mode in Zhejiang Province and Yiyang Mode in Hunan Province were introduced firstly; then the role and the function of government in the two modes were also respectively compared and analyzed; in the end, the role of government in the entrustment was determined by analyzing the legal status of government in entrustment of rural land use right.
