在《侵权责任法》实施之后,原来的举证责任倒置规则得以转变,转而实行区分类型确定举证责任的制度,这样为构筑和谐的医患关系、处理医疗纠纷发挥了较大的作用。本文首先分析了医疗纠纷举证责任倒置的局限性,其次,分析了《侵权责任法》出台后医患举证负担,具有一定的参考价值。

After the implementation of the "tort liability law",the burden of proof rules can be changed,and the distinction between types determine the burden of proof system,it has played an important role in building a harmonious relationship between doctors and patients,dealing with medical disputes.This paper analyzes the limitations of the inversion of burden of proof in medical dispute,analyzes the "tort liability law" after the introduction of the burden of proof,which has a certain reference value.
