从市场经济、民法建设和法律传统的要求等三方面论证我国民法法典化的必要性,并在比较研究大陆法系法典法与英美法系判例法基础上提出:我国民法发展只能是法典法而非判例法。

It discusses the necessity of the codification of our country's civil law from the following perspectivesmarket economy,civil law construction and the tradition law making. And on the basis of comparing the different ways of law implementation between China and the western countries.it recommends to perfect our civil law system in terms of code law in stead of case law.
