摘要
本文认为，我国５０年代后期的法制建设，受１９５７年反右派斗争扩大化及“左”倾指导思想发展的深刻影响，出现严重滑坡：党对法制建设重要性的认识发生倒退；立法工作趋于停滞；司法工作实践偏离了法制轨道。这一现象的产生，与当时社会的经济、政治缺乏足够的法制需求密切相关。与此形成鲜明对照的是，改革开放以来，我国的法制建设步入高速发展的轨道。这一事实说明，只有以建立社会主义市场经济为基础，并与政治体制改革相结合，法制建设才能获得强大持久的动力。
Over involvement in the anti rightist struggle around 1957 and development of its guideline,the “left” opportunism,severely handicapped and deteriorated construction of the legal system in the latter part of 1950s. This deterioration was manifested in three aspects:retrogression of the Party in recognizing the importance of setting up a legal system;stagnation in legislation; and a departure from the proper course in administration of justice. The fundamental causes for these lie in the absence of economic or social needs for a legal system then. In contrast with that situation,the People's Republic of China in the era of reform and open up to the world has entered the threshold of rapid development of constructing the legal system. The revelation we receive from all this is that construction of legal system must be based on construction of socialist market economy and going hand in hand with political reforms.
