关于我国亲属立法之我见

On the Legislation of Relatives Relationship in China

作为一种社会关系，亲属关系在社会中极为普遍，且涉及面广。但我国现行的法律，对亲属关系的法律调整却很少，也不系统。加强亲属立法，建立我国亲属制度势在必行。然而，如何进行亲属立法，笔者认为，仅对现行法律进行增缺补漏是不够的，而应对亲属法的法律地位，立法原则和内容体系加以明确。

Abstract As a kind of social relationship of the ethnic group,the relatives relationship is common in the society,and it touches upon almost every aspect.In China,however,the law about the relatives relationship needs to be revised and systematized.It is necessary to improve the current legislation of relatives relationship and set up regulations of relatives relationship in China.To realize this,in the authors opinion,it is not enough to modify the present law only.Instead,it is necessary to clarify the legal position,the legislation principle and the contents of the Law of Relatives.
