On the Theory of China's Economic Laws

中国经济法学的产生和发展,是近年来中国社会主义法学发展的突出表现.在中国经济法学发展的过程中,形成了不同的经济法理论.正确分析和认识中国的经济法理论是怎样形成的,它们的基本观点是什么,并且力求作出科学的评价,对于发展经济学,健全经济法制,保障和促进改革、开放和社会主义现代化建设的发展,具有重要意义.

The theory of China's socialist economic law emerged from the Third Plenary Session of the 11th National Congress of the Communist Party of China. With the deepening of economic reform, research in this specific field has gone through two phases of development. Six major hypotheses were put forward during this process, each has its unique interpretation of socialist economy. This article focuses on two basic issues: 1. the object of the adjustment in economic law; and 2. whether econo- mic law is an independent legal branch. These two issues are taken as starting points in evaluating the above-mentioned hypotheses. The object of the adjustment in economic taw should be relations of economic management and of economic coopera- tion. Economic law should also become an autonomous legal branch.
