社会法治调查课程设置及其流程化运作模式探究

Research on Curriculum Provision and Operation Mode of Social Surveys into Rule of Law

社会法治调查是认知社会、理解法律、探究法律事实并做出法律决定的基础。社会法治调查课程设置是"卓越法律人才"背景下培养目标共识性认识在高校法学专业课程设置中的逻辑延展,是社会调查方法课程的实践向度在法学专业理论课程脉络中的延续,也是法学专业理论课程在实践性运用中的理论反思与理论拓展。构建一套以提升"真实性"为主的社会法治调查课程运行流程才能确保社会法治调查课程所承载的意义得以实现,使其"实效性"得以彰显。

Social surveys into rule of law is the basis of perceiving the society,understanding the law, exploring the legal facts and making a legal decision.Its curriculum provision is a logical extension of con-sensus of training goal in the context of“excellent legal talents”in the establishment of law courses in colle-ges and universities,a continuation of practice dimension of social investigation methods in the theory cour-ses of law,and a theoretical reflection and development of professional theory course of law in practice.The paper thinks that building an operational course process with the theme of promoting“authenticity”of social surveys into rule of law can ensure the realization of the meaning of these courses,and manifests their“ef-fectiveness”.
