法治化视野下的权力监督

The Power Supervision from the Perspective of Legalization

中国式的权力监督在叠床架屋般的机构设置下效果仍不如意,根本的问题即为陈旧且固化的"人治"或"德治"的权力思维方式,要把权力真正放到制度的笼子里,就有必要去另辟蹊径探寻高效的权力监督路径,而法治化恰是权力监督的最佳契合点,它可彰显民主性、理性、高效性和科学性。法治化首先要求的就是制定规范、严密、理性的"法",其次就是对权力的分立、权力的运行、监督主体、监督程序、追责体系的法治化构建。

In the institutional settings like needless duplication,the effect of Chinese-style power super-vision is still unsatisfactory,and the fundamental problem is the stale way of thinking which emphasizes“rule of man”or“rule of virtue”.In order to put power into the institutional cage really,it is necessary to find new paths to realize efficient power supervision.And legalization is the best integrating point and it can manifest democracy,rationality,high efficiency and scientificity.Legalization first requires the establish-ment of standard,rigorous and rational laws,and secondly the legalized construction of separation of pow-ers,operation of powers,subj ect of supervision,supervision procedures,and accountability system.
