摘要
中国的行政伦理由于长期被挤压在强烈而单一的政治意识和政治标准的卵翼之下,无法同政治伦理或政党伦理划清界限,党政矛盾引发行政管理领域内耗严重、效率低下。如果不去深入探讨行政主体的自由裁量权问题,就无法全面把握行政伦理的内在奥秘。在约束行政人员的自由裁量权方面,制定的法律越是细密,为行政人员留下的自由裁量范围就越大。在法律制度无能为力的地方,应该发挥道德伦理的互补作用。
In China,the administrative ethics has long lived in the shadow of the dominant and exclusive political consciousness and political standards. Hence,it is hard to draw a line between it and political ethics or political party ethics,and party-government conflicts have caused internal frictions and severe inefficiency to the handling of government affairs. The inner mysteries of administrative ethics cannot be grasped without going deep into the issue of administrative subjects' discretionary power. With regard to limiting discretionary power of administrative subjects,the more detailed the provisions of laws are,the wider the scope of discretion conferred on administrative staff is. For areas where laws do not work,morals and ethics may fill in.
