建设工程施工合同履约监管初探

Discussion about supervision on construction contract of the construction project's agreement

建设施工合同是发包人与承包人就完成具体工程项目的建筑施工而确定双方权利和义务的协议。在国家尚未出台全国性的建设工程施工合同标后监管标准之前,笔者立足于管理部门在现行的规章框架下,结合目前实际管理工作,通过对拟签订合同主要条款的审查,规范事前施工合同价款确定行为;以《武汉市建设工程施工合同价款履约管理手册》为抓手,规范施工阶段的施工合同价款履约行为;审查事后的施工合同价款结算行为,强化竣工结算备案制度,形成工程实施阶段全过程闭合造价管理,为合理确定和有效控制造价发挥重要作用发表一些肤浅的见解、做法,与同行们共同探讨建设施工合同中的造价管理工作。

The construction contract is to confirm the agreements of both sides between contracters about finishing the construction of the concrete project of rights and obligations.Before the nationwide supervision standard issuing after bid on construction project construction contract marking in the country,I base on the administrative department under the current rule frame,combine the actual management at present,through the examination of the main clause to planning to sign a contract,standardize the cost of construction contract in advance and confirm the behavior;based on 'Wuhan city construction project construction contract cost manage manual',behavior that the construction contract cost of standardizing construction stage honours an agreement;examine the construction contract cost accounts settled afterward behavior,strengthen rules that project completion settle account is put on record,form the project practice stage fabrication cost complete whole course management,make some superficial opinion and method to make reasonable valuing and effectively controllig construction contract cost play an important role,discuss with the counterparts together about the fabrication cost management in the construction contract.
