论民办高校办学中的法律困境及其破解

Legal Dilemma of Private University Running and Its Solution

民办高等教育是伴随着高等教育投资主体多元化而兴起的,已经成为我国高等教育的重要组成部分。但随着民办高等教育的发展,诸多法律困惑亦难以回避地凸现出来,如:民办高校的"法人"地位、民办高校的产权界定、民办高校的学生管理等问题,已经出现并制约了民办高等教育的发展。本文分析了产生上述问题的原因,提出了破解民办高校办学中法律困境的对策。

Private higher education rises with the diversification of higher education investment subject.It has become an important component of higher education in our country.But with the development of private higher education,many legal problems become visible unavoidably.Such problems as the legal person status,property right definition and student management of private universities have come out and prevented the development of private higher education.The paper analyses the reasons for the above problems and presents solutions to the legal dilemma of private university running.
