荀子“礼法”法思想的价值探析

A valuable analysis of Xunzi’s legal thoughts of etiquettes and laws

在推进法治的进程中发现,现代法治文化和本土法文化在价值取向上存在着根本差异,但也有共通之处。我们在主张法治现代化时,也有必要对本土法律文化进行研究,甚至是吸收、借鉴。而荀子作为传统法文化中的大师,先秦法律思想的集大成者,其"礼法"法思想在封建社会影响深远。于我国当今法治现代化来说,它的价值问题理应受到重视。以现代法治的价值目标为视角,对荀子"礼法"法思想从正、负价值方面作理性的思辨,挖掘其现代意义,应该能够更为客观地为我国法治建设提供有益的借鉴。

In the process of advancing the rule of law,we find that there exist fundamental differences on the value orientation between the modern rule of law and local legal culture,but there is consistency between them.Therefore,we are while advocating the modernization governed by law,it is necessary to carry on our research to the legal culture in the native country,even absorb and draw lessons from.Xunzi,as the master in traditional law and culture and the epitome of Pre-Qin law thought,its thought is far-reaching in the feudal society.In today’s society by law modernization,its value should be taken seriously.If standing on the point of view of the modern value and goal by rule of law,speculating rationally from the positive and negative value of Xunzi’s legal thoughts of etiquettes and laws then unearthing its modern significance,it can provides more objectively beneficial model for the construction of ruling by law in our country.
