On Commitment in International Laws

摘要以旨在复兴欧洲的马歇尔计划为开端,采取承诺形式的协定在国际交往实践中逐渐增多,美国政府也倾向于缔结此类协定。从功能主义角度而言,采取承诺形式的协定具有生效迅速和灵活的优点。承诺一般适用于专业领域,并辅之以一定的审查机制,与具有法律约束力的条约相比,国际法上的承诺似乎更为有效。总之,承诺在国际交往中发挥了重要作用。 Commitment-a form of agreement,first started in Marshall Plan for the European recovery-is booming in practice of international intercourses.The U.S. government is in favor of signing this kind of agreement.For functionalism, agreement in a form of commitment has the merit of quick in taking force and flexibility.Commitment is generally applied to special areas and coupled with a kind of verification.To compare with the legally binding agreement,commitment in international laws seems more valid.By and large,commitment plays an important role in international intercourses.
