浅论新型用工形式——劳务派遣

摘要 劳务派遣——作为一种新型的用工形式,从它呱呱坠地于中国的第一天开始,便颇受争议,伴随着市场经济的蓬勃发展以及用工制度改革推进,它不再是一个新鲜的词语。近日,《劳动合同法》的出台为长年来劳务派遣无法可依的现象划上了句号,使劳务派遣制度进入有序发展的轨道,并逐步走向规范化、法制化。本文试从新法对派遣各方当事人的权利义务的规定,对实际用工单位的法律义务、法律风险进行浅论。 As a new form of employment,service dispatching has been under disputation since the first day of its coming in China.It is no longer a new word now with the rapid development of market economy and the reform in employment system. Recently,the implementation of Law of the People's Republic of China on Employment Contracts puts an end to the phenomenon of service dispatching without any support of law for a long period of time.It puts the service dispatching system into a good developing order,and gradually into standardization and legalization.The paper aims at discussing the legal obligation and legal risk of the working units in the perspective of the prescripts in the new law for all parts involved in the service dispatching.
