论医疗损害责任的归责原则及体系

On the System of Imputation Principle of medical Damage Liability

医疗损害责任的归责原则及体系,主要由过错责任原则、过错推定原则和无过失责任原则构成,分别调整医疗技术损害责任、医疗伦理损害责任和医疗产品损害责任三种不同类型的医疗损害责任。由于适用的归责原则不同,三种不同的医疗损害责任法律适用规则也不相同,本文拟对此分别作出评析。

The system of imputation principle of medical damage liability is made up of the principle of fault liability, the principle of presumption of fault liability and no-fault liability principle, respectively to adjust the medical technology liability, medical ethics liability and medical products liability. Because of the application of the different imputation principle, the legal application of the three different kinds of medical damage liability is different, which this paper intends to clarify respectively.
