Value Conflict and Legal Resolution of International Culture Trading——Thinking on the Conflict in Import of Sino-US Cultural Products

2008年4月10日,美国在世界贸易组织对中国提起了关于文化产品和服务的市场准入问题的诉讼。此案反映了国际文化贸易中的文化产品的贸易自由化和文化多样性二者的价值冲突和规则缺失。如何在国际层面构建合理的文化贸易规则机制,以及中国如何利用现有规则在该案中进行抗辩,都是值得深思和讨论的。

The US charged China for market permission in cultural products and service in WTO on April 10, 2008. This case reflects the value conflict and absence of rules concerning free trading and cultural diversity of cultural products in international cultural trading. It is worth a good thinking and discussion as to how to construe rational mechanism of cultural trading rules on international level and how China defends herself in such cases by utilizing current rules.
