摘要
美国依据"337条款"进行的"337调查"作为一种过于严格的贸易保护措施已经引起了巨大的争议,也给我国对外贸易企业造成高额损失,鉴于此,分析了"337条款"与WTO相关法律制度的关系来考量"337条款"的合法性。分析结果表明:"337条款"已经违背了GATT第20条前言的内容,并且也违背了TRIPs协议的权利与义务相平衡这一基本原则。对我国目前遭遇"337调查"的现状提出了应对的策略。
As an overtly rigorous trade protection measure,the 'Section 337' investigation according to 'Section 337 of Tariff Act' of the United States has aroused enormous disputes and caused substantive loss to Chinese export trade.Through reviewing the validity of 'Section 337 of Tariff Act' by analyzing the relating articles of GATT and TRIPs,the writer concludes that 'Section 337 of Tariff Act' of United States' Tariff Act violates the preamble of the Article 20 of GATT,and violates the basic principle of the equity of duty and rights in TRIPs.The paper also analyzes the coping strategies to 'Section 337 of Tariff Act' investigations.
