摘要
以合同法理论为指导,结合《运输公约草案》,论述货物控制权的性质和行使控制权的限制条件等法律问题,并针对中国海商立法的现状,提出在中国构建和整合货物控制权制度的建议。
Under the guidance of the Legal theory of contract,and combining with the Preliminary Draft Instrument on the Carriage of Goods by Sea,the legal nature and the limitation for enforcement and some other legal questions in respect of the right of control have been demonstrated.Aiming at the present conditions about maritime legislation of China,the suggestion for construction and improvement of the legal system regarding the right of control has been put forward.
