商业贿赂与宽严相济的刑事政策

Commercial Bribery and the Criminal Policy of Temper Justice with Mercy

现行刑法对商业受贿罪规定存在一定的缺陷,不利于遏制商业贿赂现象的滋生和蔓延。从商业贿赂犯罪产生原因、危害、特点进行分析看,当前应实行宽严相济的刑事政策,进一步推动刑事立法的完善。

There are some defects in the stipulations of commercial bribery crime in the Criminal Law,which makes it hard to control the occurrence and spread of commercial bribery.In view of the criminal policy of temper justice with mercy,the author analyzes the origin,harm and characteristics of commercial bribery crime,so as to help to perfect the criminal legislation.
