两岸通航中船籍证书之认定及其相关问题

Recognition of Ship's National Certificate and Concerning Problem in Navigation Between two Sides of Strait

提出了在两岸通航中双方即将面临的一个重要法律问题,即两岸主管当局对船籍证书的互相认定。文章从船籍证书之意义入手,提出了两岸通航以后围绕船籍证书之认定而即将产生的若干法律问题,并以船舶登记条件为基础,提出了两岸当局应在采取相应变通措施的前提下来解决船籍证书认定及其相关问题的构想,包括证书之形式、船旗之悬挂、法律之适用以及相关政策之采取等项内容。

An important question has been put forward in this paper,which will be faced with by both sides in navigation between two parts of the strait of Taiwan, that is the mutual recognition of ship's national certificates. Starting from the basic meaning of ship's national certificate,a certain problems of law was put forward,which will be arisen from the recognition of ship's national certificates,and the scheme was imagined for solving the problems on the basis of conditions for ship's registry with the accomodating measures to be adopted by the Governments of two sides as a presupposition, including the forms of certificates, flying of ship's flag,application of law and the concerning policy to be adopted.
