美术作品投稿的法律问题研究

美术作品创作完成以后,将其向社会传播的途径之一就是将美术作品向出版社、报刊社投稿。本文对美术作品投稿的法律问题做了初步研究,探讨了美术作品著作权人对作品发表权的行使。投稿行为的法律属性,对实践中存在的报刊作品重复刊登等现象进行了分析并提出了解决办法。

After the creation of the art works, contributing them to the publishing house, newspaper or periodical, is one of the ways to disseminate them to the public. This article makes a study in the scope of the copyright law on the legal problems concerning the contribution of the art works, discusses the performance of the copyright of the art works , the legal nature of contribution, analyses the phenomena in the practice, such as the materials repeated by the newspapers and periodicals, and proposes the resolutions in the end.
