摘要
人像摄影作品是我国著作权法保护的作品种类之一。但摄影作品上同时存在肖像人的肖像权。当依法律规定或合同约定由肖像人享有著作权时,肖像权和著作权归属于同一主体。因此不存在权利冲突。但著作权和肖像权经常会发生分离而分属于不同的主体,权利竞合和冲突由此产生。本文试图分析人像摄影作品的权利归属问题,并结合实际情况。确立两种权利冲突解决的一般规则。以此平衡两种权利和利益,最终目的是为了更好地保障民事权利,定分止争,维护社会交易安全。
portrait photographic works are under the copyright law protections in our country. When the portrait right and the copyright belong to a same holder, there is no right conflict. But quite often those two rights are split and hence the conflicts. This article discusses those ownership dis Public Installation Art putes and tries to work out a general rule of settlement that best balances the rights and interests of the two in order to secure the safety of the social trading.
