治理破产逃债的法律对策

为治理破产逃债问题 ,建议应尽快出台破产欺诈犯罪的相关规定。引入“破产管理人制度” ,构建对其有效的监督体系。进一步完善破产法中有关“处理债务人恶意处分资产”的条款。

The thesis analyse the defects of THE BANDRUPTCY LAW OF THE PEOPLE'S REPULIC OF CHINA which cope with evading debts by bankruptcy.The analysis is on bases of the enlightenment of the bankruptcy of HOUWANG group.In these defects,some are valuable and substantial problems,others are procedural and technical ones.The existence of the defects is deeply harmful to the social credit.However,the social credit is necessary to establish the market economic order,to increase the social welfare,and to decrease the cost of exchange.Then,the thesis put foward some legal solutions to cope with the defects.It is to be hoped that the thesis will be useful to solve the problem of evading debts by bankruptcy.
