试析我国离婚法定理由的基本特点

自第八届全国人民代表大会第十六次会议决定修改婚姻法以后 ,制定一部什么样的婚姻家庭法律 ,引起了社会各界的广泛重视和热烈讨论。其中 ,关于离婚法定理由如何定位的问题更备受关注。现行的婚姻法修正案在填补立法空白方面做了许多努力。

In this paper,through the analysis to the legal grounds of divorce given in the 'Marriage Law of peopple's Republic of China (Amendment)'which was passed by the National People's Congress on 28 th ,April,2001,the featrues andimprovements in the respect of divorce legislation of our nation's marriage law is elaborated,and some points of vivw about the issues which should be noticed in the practice on enforcing the law is advanced .
